Filing Bankruptcy

Filing bankruptcy can be one of the toughest decisions that a person will ever have to make.  Filing for bankruptcy can have an impact on a consumer’s credit situation, as well as their employment opportunities.  Most people are aware of the fact that filing bankruptcy will stay on one’s credit for 7-10 years.  Having a bankruptcy on your credit report will likely have a negative impact on your ability to attain more credit.

Additionally, if you are able to attain more credit, you will likely pay a much higher interest rate then someone without a bankruptcy on his or her credit report.   You also need to realize that credit grantors will consider a person who has filed bankruptcy a less qualified loan candidate than a consumer who has not completed filing bankruptcy. Additionally, the credit card offers you’ll begin to receive will carry with them a “higher risk” interest rate than you had before the bankruptcy. Another negative is that due to a new change to the bankruptcy law, filing bankruptcy has become even more difficult.  Since filing bankruptcy is no longer an option for many consumers, you should be aware of any warning signs you may be experiencing.  If you can recognize that you may be looking at filing bankruptcy down the road, then you should begin to make the changes needed now to avoid filing bankruptcy in the future.

If you do end up filing bankruptcy you will be required to file a petition in Federal Court.  When filing bankruptcy you will have to provide a statement of assets and liabilities as well as schedules that list all of your creditors and the amount they are owed.  Once you have finished filing bankruptcy, your debts will be discharged.  Filing bankruptcy limits your personal spending, since you are only allowed to purchase items deemed to be a necessity by the court.
